FTX investors and clients are suing SBF in civil court. SBF spokesperson Mark Botnick revealed the hire in an email. According to Botnick’s email, David Mills, a professor at Stanford Law School, is advising on the situation as well.
Mark Cohen, a partner of Cohen & Gresser, formerly served as the Eastern District of New York’s associate US attorney. Cohen has previously worked for Ghislaine Maxwell and El Chapo.
In contrast, Sam Bankman-Fried had previously employed Martin Flumenbaum to protect him against civil claims. However, Flumenbaum’s company claimed that due to disputes, Flumenbaum was no longer representing SBF.
Bankman-Fried has been extensively questioned in numerous forums since FTX collapsed, going against what might be conventional legal advice to keep quiet and describing his actions as the exchange’s leader as possibly stupid but not unlawful. However, the stakes have recently increased after Rep. Maxine Waters (D-Calif.) strongly recommended that SBF appear the following week before the House Committee on Financial Services, which she chairs and where he would likely be required to take an oath.
