Yuga Labs, the company behind the popular NFT collection Bored Ape Yacht Club (BAYC), has decided to take the BAYC accuser to court. For their part, the defendant is also prepared to stand trial.
As updated in a Coincu News article, the NFT community shared a YouTube video over an hour-long post on June 20, claiming to “unveil” the truth about the ideals behind the most popular NFT project today, now Bored Ape Yacht Club (BAYC). Throughout the video want to emphasize that the NFT project is fascist and racist.
In response, on the morning of June 25, the founders of Bored Ape Yacht Club, represented by Gordon Goner, published a blog post refuting the allegations. In the article, Gordon Goner stated that the four founders of BAYC had no reason to support fascism with Jewish, Turkish, Pakistani, and Cuban backgrounds. Goner also alleges it’s just a conspiracy to smear the project to sell NFT.
When Ryder Ripps – who started it all – launched an NFT collection that was a 100% copy of BAYC, Yuga Labs decided to sue him for “trademark infringement”.
To prepare for the trial, Ryder Ripps hired an attorney representing Louis Tompros from the law firm Wilmer Hale. This lawyer is well known in the NFT circles for being the representative of the creators of “Pepe the Frog”.
Tompros is a seasoned IP litigator, known for representing Pepe the Frog creator Matt Furie in multiple suits against far-right organizations accused of co-opting Pepe as a racist and white supremacist meme.
“The complaint appears to be an attempt to shut down Ryder’s artistic criticism of Bored Ape Yacht Club as racist and as problematic for a variety of other reasons,(…). Our plan is to respond, to explain why the lawsuit is baseless and why the use of trademark law in this type of context is inappropriate.”
Tompros told Decrypt
When asked whether Ripps would be inclined to settle, or take this case all the way to trial, Tompros responded
“We’re perfectly happy to let this go to trial and let the court resolve it. I’m involved for exactly that purpose.”
