Bitboy Announces Will Drop The Lawsuit With Atozy

Ben Armstrong, the man behind Bitboy Crypto announced that he would drop the lawsuit after Mengshoel Jr – Atozy raised over $200,000 to defend him. The original intent of the lawsuit was to ask Mengshoel Jr to take down the video and suggest that he didn’t really want to go through the proceedings in court.

Ben Armstrong, the man behind Bitboy Crypto says he is dropping a defamation lawsuit against YouTube content co-creator Erling Mengshoel Jr., who goes by the name Atozy.

Armstrong has officially filed a lawsuit against Mengshoel Jr. on August 12 in response to a November 2021 video titled “This YouTuber Scammed His Fans… Bitboy Crypto” alleges that Armstrong dishonestly promoted questionable assets to an audience his fakes, such as PAMP for his own gain. He is claiming $75,000 in post-trial damages.

However, Armstrong hinted during an August 24 live stream that he is now returning to the complaint after Mengshoel Jr raised more than $200,000 to defend him.

“I guess I didn’t understand that my name is now so big that if I file a lawsuit, it will be found and made public,” he said in a 16-minute prologue to his regular daily livestream show. “Obviously, if [I knew] this would have been public, I wouldn’t have done it.”

Armstrong explained that since Atozy currently has enough to cover the legal costs, and with popular podcast/crypto trader like Cobie (Jordan Fish) donating $100,000 to the cause, the dispute has gone far than he originally intended.

“We are going to drop the lawsuit, 100%,(…). I’m sorry this became public, I’m sorry that this has been misconstrued.”

Armstrong said

“This was not about a slapstick lawsuit,” he explained, referring to so-called SLAPP lawsuits, which are intended to silence criticism.

“When someone means you can be in trouble from the SEC, that is not frivolous, that’s a very, very big, serious, serious matter.”

Commenting on the matter, Atozy said that all is still unresolved, as he is still waiting for official confirmation from his lawyer that the complaint has been dismissed. After confirming the procedures are complete, the donation amount will be returned.

“I’m told by my lawyer that if it is not with prejudice he can refile at any time,” he wrote, adding that once the official confirmation has come through, he will refund all the money to everyone that donated to the cause.
