Montenegrin Supreme Court Delays the Extradition of Do Kwon

This is a result of the court’s analysis of the August 2 protection of legality submission by the Supreme State Prosecutor’s Office, which was a challenge to prior decisions of the High Court in Podgorica and the Court of Appeal.

This judgment will put a halt to the execution of the extradition order until a final decision on the appeal of the VDT. The substance of the VDT’s appeal concerns the validity of decisions by the High Court and Court of Appeal that had earlier consented to the extradition of Do Kwon to South Korea while refusing a similar request from the United States.

Legal and Political Controversies

The lawyer of Kwon, Goran Radic, stated that the judge’s delay undermines the rule of law. Radic also said his case was one of a number of incredible series of legal inconsistencies, like a previous ruling that agreed Kwon should be extradited to the United States but was later overturned by another court because of the bad procedure. According to him, “the Supreme Court can discuss this issue in the regular procedure in accordance with the usual dynamics of work.”

Kwon, accused of having defrauded investors of $40 billion in the cryptocurrency ventures, has been in Montenegro since his arrest in March 2023 at Podgorica airport. His case has seen the issuance of court decisions with conflicting results on the extradition of Do Kwon and has become involved in local political conflicts.

With Kwon down at the Aliens Shelter, Supreme Court ruling is what is left to determine whether he will be sent back to South Korea, other than the obvious, or not.
